1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of nationalgroupllc.com and any services provided by National Group LLC, an Oregon limited liability company with offices at 16347 SE Pleasant Valley Pkwy, Happy Valley, OR 97086. By using the website or requesting services, you agree to these Terms on behalf of yourself and any organization you represent.

2. Nature of our services

National Group LLC arranges freight transportation as a property broker and coordinates warehousing through partner facilities. Except where we expressly state otherwise in writing, we are not the motor carrier and do not take physical possession of your goods. Transportation is performed by independent, licensed, and insured motor carriers selected by us.

3. Quotes and rates

Quotes are estimates based on the information you provide and are valid for seven calendar days unless stated otherwise. Rates assume accurate commodity descriptions, weights, dimensions, freight class, and accessibility of the pickup and delivery locations. If the actual shipment differs, the carrier may reweigh, re-measure, or re-class the freight and additional charges will be passed through with supporting documentation.

4. Your responsibilities as shipper

• Provide accurate and complete shipment information, including any hazardous material classification.
• Package and label freight so that it can withstand normal handling in commerce.
• Ensure that pickup and delivery locations are accessible and that personnel are available during the agreed window.
• Inspect the shipment at delivery and note any shortage or damage on the delivery receipt before signing.
• Comply with all applicable laws, including export controls and hazardous material regulations.

5. Prohibited commodities

We do not arrange transportation of household goods moves, live animals, human remains, cash or negotiable instruments, firearms or ammunition, illegal substances, or any commodity requiring a federal license we do not hold. We may decline any shipment at our discretion.

6. Payment terms

Unless credit terms have been approved in writing, charges are due before pickup. Approved accounts are invoiced with net-15 or net-30 terms from the invoice date. Past-due balances may accrue a service charge of 1.5% per month, or the maximum permitted by Oregon law, whichever is lower. You remain responsible for charges even where you have instructed a third party to pay.

7. Cancellations

Shipments may be cancelled without charge before a carrier has been dispatched. Once dispatched, a truck-order-not-used fee may apply. Full details appear in our Billing and Refunds policy, which forms part of these Terms.

8. Cargo claims

Claims for loss or damage are governed by the Carmack Amendment (49 U.S.C. § 14706) and the carrier's tariff. Note exceptions on the delivery receipt, notify us within 24 hours of delivery, and file a written claim within nine months of delivery. We will file and pursue the claim with the carrier on your behalf and keep you informed, but we are not the insurer of your goods and our liability is limited as set out below.

9. Limitation of liability

To the maximum extent permitted by law, National Group LLC's total liability arising out of or relating to any shipment shall not exceed the lesser of the actual proven loss or the total service fees we received for that shipment. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, production downtime, or loss of goodwill, even if advised of the possibility.

10. Force majeure

Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including severe weather, natural disasters, road or port closures, labor disputes, civil unrest, government action, epidemics, or failure of utilities or communications networks.

11. Website use and intellectual property

All text, images, and design on this website are the property of National Group LLC or its licensors and may not be copied, republished, or used commercially without written permission. You agree not to attempt to disrupt the site, scrape it at volume, or use it for unlawful purposes.

12. Indemnification

You agree to indemnify and hold harmless National Group LLC, its owner, and its personnel from claims, damages, fines, and reasonable legal fees arising from your breach of these Terms, inaccurate shipment information, improper packaging, or violation of applicable law.

13. Governing law and disputes

These Terms are governed by the laws of the State of Oregon without regard to conflict-of-law principles. The parties will first attempt to resolve any dispute in good faith by direct discussion. Any unresolved dispute shall be brought exclusively in the state or federal courts located in Clackamas or Multnomah County, Oregon, and each party consents to that jurisdiction.

14. Changes to these terms

We may revise these Terms from time to time. The version in effect at the time you request a service governs that transaction. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
